  • Common Assault vs Actual Bodily Harm

    Yesterday, I had a big scare with my girlfriend. She was on her way back from college, she was protecting a little boy who was a couple years younger than her as he was being bullied by some boy who is 16 and just finished school.

    The boy got on the bus and starting smoking and harassing other kids, one in particular who my girlfriend is friends with. So she stood in front of the little boy and said 'What are you going to do?' so the **** pushed my girlfriend back and was like 'Why what are you going to do!?' so she pushed him back to get him away from her to which he then grabbed her by the neck and started to strangle her, smashing her head on one of the poles that people hold onto on the bus. Then bent her head back and started to punched her in the race repeatedly whilst strangling her. One of my girlfriends friends then jumped in and pulled him off her as she was going pale from being strangled and blood all over her face to which the boy elbowed her in the chest and then ran off.

    Later on after waiting at the hospital for hours the other girl got a fractured rib. At the time the boy was caught and charged with common assault, but seen as he actually caused bodily harm by fracturing this girls rib means that he actually caused Actual Bodily Harm (ABH). However, he is not being charged for this.

    There is a court hearing on the 5th August to decide on this case, what do you think the turn out will be? I've seen these situations turn around before and the bad person getting let off. It's like the police don't even care. There was CCTV on the bus which should provide enough evidence against him, but as he is a juvenile I doubt that he will go to prison for this.

    ****ing makes me sick when people fight over stupid little things to make themselves feel bigger, and seen as he beat up my girlfriend who was just protecting someone is just ridiculous. As you can tell I'm pretty pissed off, there is nothing I can do either as I'm over 18 and he us under so I could get in even more trouble if I decide to act out.

    That sort of behaviour is disgusting regardless, but to do that so publicly to a girl is sickening.

    Doubt an awful lot will come of it, he'll get a slapped wrist, maybe a fine and an asbo. Depends if he's a repeat offender.

    Shame really as it seems he deserves far more than what he'll probably get.

      I know I spent all night at the hospital with her until she was let go, the bruising on her face has meant that she can't open her jaw to far either.

      The police said they know him so he has obviously a bad person. Sometimes when I'm out at the weekends I have seen him about picking a fight with people all the time, never really thought much of it until he has directly affected me.

      If he doesn't get any time or he is just let off I'm really going to be annoyed, this countries justice system is stupid.

          Is it going to Crown Court or Magistrates?

          If it goes to Crown (which I highly doubt unfortunately) you can appeal against the sentence if you believe its unfair and too low for the severity of the crimes committed.

          Check here if you need it Ask for a Crown Court sentence to be reviewed

          Also you'll obviously receive direct compo from him for damages, loss of earnings etc
          .

            It's commendable that your girlfriend stood up for someone else, but unless she's good at fighting then it was a bit too bold to shove someone that's acting so violently.

            Guy won't get jail for it. He will probably get a social worker if he's under 16 and counselling. From my experience of growing up with people like that they rarely ever change and the only thing that stops them for a while is a good kicking. Not very constructive but their mindset is usually too primitive for anything else.

              Only the firing squad will sort out the problems caused by the lack of discipline instilled in the kids today, and adults for that matter.

              You cant have anything, you cant do anything, you cant go anywhere for dickheads.

              I probably sound like Adolf Hitler, but I've seen most ****holes this country has to offer and everything tried so far fails, and it never used to be such an issue - so what's missing?

              She stood up for someone else though, and even if she did get messed up and even if she could "fight" it's not really the job for a female (called me old fashioned) but can do nothing but praise anyone standing up for anyone else either with the ability to help or not.

                  I disagree on two parts.

                  Look at America. Criminals get beat up my Police and sometimes even shot or put to death. All that seems to do, by looking at the way crime is there is create hardened criminals.
                  Countries like Sweden have very low violent crime figures and yet they are softer on criminals than we are in the UK. Conclusion is violence on the large scale can't be solved by more violence.
                  Lock them up, re-educate them somehow or see if they are a to the public due to mental health problems and ensure they get treated for them and not released until they're better.

                  The second part is "not really a job for a female"
                  It's both old fashioned and sexist.

                    its certainly ABH rather than common law assault, however the police will more than likely seek prosecution on an offence they know will get a conviction, therefore common law assault rather than ABH

                      Apparently he was on bail for assault of some kind whilst this happened, so I hope this is enough to have him get in any kind of trouble possible, little **** needs to rot in hell.

                      I blaim society really, letting people get away with it meaning more people jump on the band wagon as an image to look 'hard'

                        How old is your girlfriend?

                        Also why provoke him by saying 'what you going to do', I think he proved what he was going to do. I've seen this way to much from lasses, being very provactive because they think lads wont hit them. If I stood up to someone and said what she said and pushed the lad I would expect to get into a fight.

                        What the lad was wrong and hopefully the full weight of the law is applied, however lasses really need to consider the consequences before doing things like this.

                        Now if she'd taken her friend to the front of the bus out of the lads way, she may have had a small dent I'm pride but wouldn't be in the situation she is now.

                          She's 17 but 18 in like 10 days, what luck before her birthday aye.

                          She lead the little boy to the back of the bus and tried to get this other boy off the bus but he pushed her and then it went from there

                            Usually these types of people eventually push their luck with the wrong people later in life and they get a harsh lesson in Karma.
                            The bully i mean. He'll hit or annoy the wrong person and he'll be the one on the receiving end of a beating and that's usually enough to make them think twice in future.

                              Yeah one day he will try to up his game and pick on someone rather than a defenceless child.

                              Can't believe people who pick on anyone but especially a child to make them selves feel bigger. Nothing better to do than cause trouble. Makes me sick.
